AUGUSTA — Mark P. Murphy, hands cuffed and linked to a belt around his waist, ankles shackled, agreed Wednesday to a jury-waived trial on charges that he attacked and severely injured a 26-year-old mental health worker at Riverview Psychiatric Center in March.

Murphy, 47, formerly of Eliot, signed the waiver of jury trial in Kennebec County Superior Court. His attorney, Charles T. Ferris, was with him.

Murphy is being held at the Maine State Prison in Warren while the two charges of elevated aggravated assault and one of aggravated assault are pending.

He pleaded not criminally responsible to those charges after being found competent to enter a plea.

Previously, Murphy, who has a history of assaulting Riverview patients and staff, was found not criminally responsible for various offenses.

On Feb. 1, 2006, he was found not guilty by reason of mental disease or defect on a charge of aggravated criminal trespass for breaking into a neighbor’s home in York County in November 2004. The homeowner shot Murphy in the chest.

Murphy was placed in the custody of the commissioner of health and human services and placed at Riverview; but within six weeks of his arrival, a report filed with the court indicates, he committed three assaults on staff members, one nearly fatal.

In the pending charges, he is accused of attacking the woman and stabbing her multiple times with a ballpoint pen. The woman underwent surgery to remove the point of the pen from her hand. The trial date has yet to be set.

A police report indicates another Riverview patient, Kirk T. Lambert, helped rescue the woman.

Murphy’s hearing was one of many that took place Wednesday in Kennebec County Superior Court.

* Kenneth Floyd, 31, of Bronx, N.Y., possession of cocaine base and criminal forfeiture of $8,242, July 1 in Augusta; two-year jail sentence, all but 60 days suspended, two years’ probation, $400 fine.

* Billy Pizarro, 33, of Lewiston, two counts of assault May 5 in Augusta; 50-day jail sentence (credit for 50 days served), $600 fine.

* Lori M. Kervin, 28, of Augusta, disorderly conduct June 27 in Augusta; $200 fine, all suspended, $200 restitution.

* Benjamin L. Robichau, 24, of Monmouth, operating under the influence May 27 in Winthrop; 180-day jail sentence, all but seven days suspended (to be served in the alternative sentencing program) one-year administrative release, $700 fine, three-year license suspension.

* Micaela Roy, 21, of Lewiston, operating under the influence May 27, 2013, in Gardiner; $500 fine, 90-day license suspension, $1,820.98 restitution.
